Financial Holdings Limited (“we”, “us”, and “our”) is the owner of this website (“Financial Holdings”). Financial Holdings is a Jersey company with its registered office at One Liberty Place, Liberty Wharf, La Route de la Liberation, St. Helier, Jersey, JE2 3NY and includes “Smart Money” as a registered business name. We are registered under the Proceeds of Crime (Supervisory Bodies) (Jersey) Law 2008 for Schedule 2 Business pursuant to Article 14 of that Law and are regulated by the Jersey Financial Services Commission.

The term ‘you’ or ‘your’ refers to the user or viewer of the Financial Holdings website.

Financial Holdings will determine, at its sole discretion, whether a Contribution breaches these Content Standards.

  • Comply with applicable laws in Jersey and any jurisdiction from which it is posted.

A Contribution must not:

  • Be defamatory of any person.
  • Be obscene, offensive, hateful, or inflammatory.
  • Promote sexually explicit material.
  • Promote violence or unlawful conduct.
  • Promote discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age.
  • Infringe any intellectual property rights of others.
  • Be misleading or deceptive.
  • Breach any legal duty owed to a third party, including confidentiality or contractual obligations.
  • Promote illegal activity.
  • Be in contempt of court.
  • Be threatening, abusive, invasive of privacy, or cause unnecessary distress or anxiety.
  • Harass, intimidate, or annoy any individual.
  • Impersonate any person or misrepresent identity or affiliation.
  • Give the impression that the Contribution originates from Financial Holdings where it does not.
  • Encourage or assist unlawful or criminal activity.
  • Contain statements likely to be interpreted as encouragement or incitement to terrorism.
  • Contain advertising or promote external services or links.

Where we determine that a breach of this Acceptable Use Policy has occurred, we may take any action we consider appropriate.

Failure to comply with this Acceptable Use Policy constitutes a material breach of these Terms of Use and may result in any of the following actions:

  • Immediate, temporary, or permanent withdrawal of access to our site.
  • Removal of any Contributions posted by you.
  • Issuing a warning.
  • Legal proceedings for recovery of costs and damages.
  • Further legal action as appropriate.
  • Disclosure of information to law enforcement or regulatory authorities where required or appropriate.

We exclude liability for actions taken in response to breaches of this Acceptable Use Policy. The actions listed are not exhaustive, and we may take any additional steps we reasonably consider necessary.

Governing Law and Jurisdiction

If you are a consumer, please note that these Terms of Use, their subject matter, and their formation are governed by applicable laws. You agree that the courts with appropriate jurisdiction shall have exclusive authority to resolve any disputes arising out of or in connection with these terms.
